The San José City Council directed the Housing Department to explore a source of income ordinance. This ordinance would ensure that all persons with an ability to pay for housing are considered, regardless of whether they receive rental subsidies of any kind. To learn more about this topic before the meetings, you may review the following Staff Report to City Council.

The Source of Income Ordinance addresses three program components which include:
  • What rentals are covered?  The Ordinance explains that all rentals are covered including single family homes, duplexes, all rental housing with three apartments or more, co-living apartments, accessory dwelling units, and guest houses.  The only exclusion are rooms rented within a single family home where the owner lives within the home.
  • What actions are not allowed?  Landlords may not turn away an applicant for an apartment due to a Section 8 voucher or any other assistance, may not require different lease terms, and may not advertise stating "No Section 8" or other assistance.
  • What are the penalties?  The City may issue a warning for the first violation, and issue administrative citations for each subsequent violation.  The City may take civil action to enforce the Ordinance, and a private party may bring forward legal action under the Ordinance.
