~ Sacramento, California - In a major victory for Governor Gavin Newsom and the state of California, a federal court has ruled that President Donald Trump's use of the National Guard in Los Angeles is illegal. The court's decision serves as a strong rebuke to Trump's attempts to create a national police force with himself as its chief.

The ruling, which was issued on September 2, 2025, makes it clear that no president is above the law and that states have the power to protect their citizens. Governor Newsom expressed his satisfaction with the court's decision, stating that "the court sided with democracy and the Constitution."

The Court's findings state that the defendants, which include the Trump administration, are "enjoined from deploying, ordering, instructing, training or using the National Guard currently deployed in California" for any law enforcement activities. On June 10, 2025, Newsom and Attorney General Bonta filed an emergency request for the court to block Trump from expanding the current mission of federalized Cal Guard personnel and Marines in Los Angeles. This mission orders soldiers to engage in unlawful civilian law enforcement activities beyond just guarding federal buildings.

The impact of this ruling goes beyond just stopping Trump's use of the National Guard in Los Angeles. The California National Guard estimates that over 4,000 servicemembers were pulled from essential civilian duties such as medical and first responders, service workers, building trades contractors and more. These servicemembers were reassigned by President Trump to militarize Los Angeles instead of fulfilling their usual duties such as combating transnational criminal organizations and seizing illegal narcotics.
