NOTICE OF AVAILABILITY OF A DRAFT SUPPLEMENTAL ENVIRONMENTAL IMPACT REPORT (EIR) AND PUBLIC COMMENT PERIOD
The City of San José (City) has prepared a Draft Supplemental Environmental Impact Report (SEIR) to the Envision San José 2040 General Plan EIR for the 2023-2031 Housing Element Update. The City proposes a general plan amendment to facilitate development of the City's 2023-2031 Regional Housing Needs Allocation (RHNA) of 62,200 units (project). The project would also include reallocation of 3,095 planned dwelling units from the North San José growth area to other growth areas identified in the Envision San José 2040 General Plan (2040 General Plan). The project is intended to facilitate the development of housing units already planned for as part of the 2040 General Plan; the project would not increase residential development capacity in the City beyond what was envisioned in the 2040 General Plan.
Location: The project location comprises the City of San José which is located in the easterly half of the Santa Clara Valley at the southern tip of the San Francisco Bay.

The proposed project will have significant and unavoidable environmental effects with regard to aesthetics, agricultural land, air quality, biological resources, greenhouse gas emissions, noise, population and housing, and transportation. The California Environmental Quality Act (CEQA) requires this notice to disclose whether any listed toxic sites are present at the project location. While there are multiple sites Citywide on the list, none of the housing opportunity sites identified in this Housing Element Update are contained in the Cortese List of toxic sites.
The Draft EIR and documents referenced in the Draft EIR are available for review online at the City of San José's "Active EIRs" website at www.sanjoseca.gov/activeeirs and are also available at the following locations:
The public review period for this Draft SEIR begins on March 13, 2023 and ends on April 27, 2023. Written comments must be received at the Planning Department by 5:00 p.m. on April 27th, 2023, in order to be addressed as part of the formal EIR review process. Following the close of the public review period, the Director of Planning, Building, and Code Enforcement will prepare a Final Supplemental Environmental Impact Report that will include responses to comments received during the review period. At least ten days prior to the public hearing on the SEIR, the City's responses to comments received during the public review period will be available for review and will be sent to those who have commented in writing on the SEIR during the public review period.
